Art. 4 – Online purchase, conclusion and payment
The booking is made through the 565AgentExpress online procedure. Before placing the order, the Customer can review and correct the entered data, the service, date, price and payment method. Where required for consumer contracts, the final order control clearly indicates that the order entails an obligation to pay. The contract is concluded when the booking and payment are confirmed according to the selected method. For bank transfers, the date may remain reserved pending manual confirmation of receipt. The system may retain technical records necessary to document the transaction and the version of the terms accepted.
Art. 5 – Venue, technical and organisational requirements
The Customer is responsible for ensuring lawful access to and use of the venue, the permissions and licences falling within the Customer's responsibility, adequate electrical supply and safe working conditions. Art. 6 – Cancellation, date changes and force majeure
If the Artist cannot perform due to illness, accident, serious unforeseen circumstances or force majeure, the Customer will be informed as soon as reasonably possible and the parties will seek an appropriate solution, which may include rescheduling or reimbursement of amounts relating to the unperformed service where required. For outdoor events, adverse weather and unsafe conditions are handled according to the specific circumstances and applicable law. Customer cancellation or date-change requests are subject to availability, costs already incurred and the terms agreed for the specific order. Neither party is liable for failure caused by events beyond its reasonable control to the extent recognised by applicable law.
Art. 7 – Applicable law and jurisdiction
For contracts with professionals, companies or entities, the contract is governed by Italian law and, subject to mandatory rules, the Court of Pavia shall have jurisdiction. Consumers retain all mandatory protections applicable to them. A consumer habitually resident in another country is not deprived, by a choice of law, of mandatory protections that would otherwise apply under the relevant conflict-of-law rules.
Art. 8 – Electronic acceptance
The contract may be concluded electronically. The system records the contractual version associated with the order. Where legally required for professional/business customers, clauses requiring specific approval are presented for such approval. Mandatory consumer protections remain unaffected.
